GitHub allows users to submit 'DMCA takedown notices' to request the removal of copyrighted content. Furthermore, it accepts 'DMCA circumvention notices' to request the removal of projects that circumvent copyright management and restrictions. For example, in March 2025, Nintendo submitted a DMCA circumvention notice targeting repositories related to Nintendo Switch emulators, resulting in the removal of over 4,300 repositories.

The following is the annual number of DMCA evasion prevention notifications, including data for 2025, as published by the GitHub Transparency Center . In 2015 there were 18 notifications, the number surged to 365 in 2022 after GitHub updated its DMCA takedown request form to clearly add questions about evasion, and in 2025 it reached a record high of 645 notifications, a 41% increase from the previous year.

The following graph shows the number of DMCA deletion notices per half-year, with the vertical axis representing the number of deletion notices processed and the horizontal axis representing the number of projects deleted. In the second half of 2025, there were 1,354 processed notices and 29,267 deleted items, both record highs. For the entire year of 2025, including the first half, it was reported that 2,661 deletion requests were processed and 47,228 repositories were deleted.

In its Transparency Report blog, GitHub mentions the Supreme Court ruling in the case of Cox Communications and a group of music companies. In that case, an ISP was sued by a major record company group for 'failing to completely eliminate users who repeatedly infringe copyrights and profiting from piracy,' but the court ruled that 'simply continuing to provide services to subscribers suspected of copyright infringement does not constitute aiding and abetting copyright infringement.' GitHub states that 'this ruling helps to avoid liability arguments that would make it difficult for intermediaries (including GitHub) to survive and operate. For developers, this legal certainty supports innovation, collaboration, and the continued availability of neutral infrastructure that enables legitimate activities like those on GitHub.'
