The bill that X is concerned about is S895B, commonly known as the 'Hate Concealment Prevention Act,' which was signed by New York Governor Kathy Hawkle in December 2024. The bill requires social media companies to report how they define hate speech, misinformation, and other harmful information and what measures they are taking against them.

The bill was created by Democratic Sen. Brad Hoylman-Sigal and State Assemblywoman Grace Lee in collaboration with the Anti-Defamation League to seek transparency and accountability for harmful online speech.

When the bill was passed, Senator Sigal and others mentioned that X had requested consultations on amending the bill in early 2024, but they refused the consultations because they believed that 'X was trying to weaken the bill rather than engage in sincere discussions to improve the bill.'

X's lawyers argued that the Hate Concealment Prevention Act would require the submission of highly confidential information, undermining the more important First Amendment protection of free speech. Meanwhile, Assemblyman Segal and others countered, 'We cannot accept attempts to use the First Amendment as a shield against the transparency New Yorkers need.'

Incidentally, X also filed a lawsuit in 2023 against a California law with the same intent.

In this case, provisions requiring social media companies to define and disclose their policies regarding hate speech, etc., and to flag posts related to such categories and report on deleted data were deleted, and the state of California paid X approximately $350,000 in legal fees, and X won the case.
