This was before the announcement of the Nintendo Switch 2, but Genki initially claimed that they had created the mockup by accessing a genuine Nintendo Switch 2 console. However, they later explained that the mockup was based on leaked information.

Genki boasted that it had exclusive access to the unannounced Nintendo Switch 2 at CES 2025, allowing attendees to get their hands on a mockup of what it called the 'successor to the Nintendo Switch.'
The public discussion and confusion surrounding Genki's announcement was so great that Nintendo issued a statement to reporters on January 10, 2025, saying, 'The gaming hardware that Genki presented as Nintendo hardware at CES was unofficial and was not provided to Genki by Nintendo.'
However, on January 20, 2025, Genki posted a photo of CEO Edward Tsai on his official X (formerly Twitter) account with the caption, 'Genki ninjas infiltrate Nintendo's Kyoto headquarters.' Nintendo responded by saying, 'This is clearly an attempt to mislead the public into thinking that Genki has acquired a Nintendo Switch 2 or is affiliated with Nintendo,' and criticized Genki.

Genki has since updated its website with an advertisement stating, 'Can you keep a secret? We can't...' and using the popularity of the Nintendo Switch 2 to deceive users.

Nintendo has sued Genki for trademark infringement, unfair competition, and false advertising. Nintendo claims that it has never provided Genki with a Nintendo Switch 2, stating that 'it is impossible to ensure compatibility of the accessories unless the defendant (Genki) obtains a Nintendo Switch 2 console.'
Nintendo further alleges that 'Genki misled consumers by representing himself as owning a genuine Nintendo Switch 2 when he did not,' and that 'Genki illegally obtained proprietary technical information about the Nintendo Switch 2 prior to its release.'
Nintendo claims that the videos, renderings, and photographs created by Genki infringe Nintendo's copyrights, and that they have 'attracted significant attention from the media and the public, causing confusion among consumers as to the veracity of Genki's statements and their association with Nintendo.'
Nintendo is demanding that Genki cease using 'Nintendo Switch' in its marketing, destroy any products or marketing that use Nintendo's copyrights, and 'recover all damages suffered by Nintendo as a result of Genki's copyright infringement, unfair competition, and false advertising, and pay triple the amount of such damages.'
In court documents for the lawsuit, Nintendo revealed that it began development of the Nintendo Switch 2 shortly after the launch of the Nintendo Switch. 'We began planning for the successor to the Nintendo Switch shortly after its launch, with formal hardware development beginning around 2019,' Nintendo explained.
