On April 22, 2025 local time, the National Advertising Review Bureau (NAD) of BBB National Programs , an independent non-profit organization that oversees advertising industry self-regulation programs, recommended that Apple revise or discontinue advertising content regarding the availability of certain features in relation to the launch of its AI-powered Apple Intelligence tool in the United States as part of its market surveillance program.

NAD's investigation focused on explicit or implicit claims made on the Apple Intelligence webpage and in promotional materials for the iPhone 16 and iPhone 16 Pro. In Apple Intelligence, Apple advertised that 'priority notifications,' 'image generation tools ( Image Playground , Jen Moji , Image Magic Wand ),' 'ChatGPT integration into Siri and writing tools,' and 'new Siri' would be 'available now,' but the company pointed out that this would create a misunderstanding that these features would be available at the launch of the iPhone 16 series.

Apple did not release Apple Intelligence's 'priority notifications,' 'image generation tools,' and 'ChatGPT integration into Siri and writing tools' features at the same time as the launch of the iPhone 16 series, but released them in stages from October 2024 to March 2025. In addition, NAD pointed out that Apple's disclosures (such as footnotes) were not clear enough and not conspicuous, making the phrase 'available now' inappropriate.

In addition, features touted as 'new Siri' features, such as screen authentication, personal context, and cross-app actions, are advertised under the heading 'Available Now.' However, these features are not available at the time of writing.

As a result, NAD recommended that Apple revise or remove its promotional materials. Apple notified the company that it had updated its webpage in accordance with NAD's recommendation. In fact, at the time of writing, if you visit Apple's

page promoting Apple Intelligence , you will see that the 'Available now' message has disappeared.



In addition, Apple has also removed the 'More Personal Siri' promotional video from the app. The NAD has not reviewed these claims, but said it will 'treat them as a NAD recommendation for discontinuance from a compliance perspective.'
